Terms and Conditions
Welcome to the website www.webjet.com.sg (the “Website”) of Webjet Singapore Pte Ltd (“Webjet SG”). Acceptance of these Terms and Conditions(“T&C”) is a condition of booking and is your acknowledgement that you have read, understood and agreed to be bound by them.
PLEASE REVIEW THESE T&C CAREFULLY BEFORE YOU START TO USE THIS SERVICE. IF YOU DO NOT AGREE TO ALL OF THESE T&C, YOU CANNOT USE THIS SERVICE. Once you start using this Service, you will be deemed to have (a) agreed to abide by these T&C and (b) accepted all aspects of the T&C on an “as-is” basis. The T&C have legal-binding effect on Webjet SG and all users of this Service.
1. The "Service"
1.1 The “Service” includes the Webjet SG Website, the software associated with the Website and the facility to enter into transactions with certain parties whose content appears on the Website.
2. Software
2.1 When you access the Website (a "Visit"), you are using software which is owned by or licensed to Webjet Singapore Pte. Ltd. For each Visit, Webjet SG, grants you a personal non-exclusive license to use the software associated with the Website for the duration of the Visit and for the sole purpose of making airline, car hire, accommodation, insurance or any travel products enquiries and bookings ("Licence").
2.2 This Licence does not permit you to make a Visit for the purpose of "carrying on a business as a travel agent" within the meaning of Singapore legislation regulating travel agents, unless you are a licensed travel agent under that legislation. Any other use, commercial or otherwise, of the software or information on the Webjet SG Website without the express written permission of Webjet SG is strictly prohibited, including any reproduction, data mining, automated querying or similar data extraction processing.
3. Acceptance and Confirmation of Terms and Conditions Relating to the Service
Webjet SG owns the Service, and reserves all of the rights relating to it, including the rights to (a) make changes to, restrict or curtail the Service at any time without prior notice to you or any other user(s) and/or (b) exclude you from continuing your access to and use of the Service without the need to provide you with any explanation or compensation.
4. Change of the Terms and Conditions of Service
Webjet SG reserves the right, at their sole discretion, to change, modify, add or remove portions of the T&C at any time. Your use of this Service constitutes your acceptance of the T&C, including changes to the T&C posted on the Website from time to time, as being in full force and effect at the time of your last use of this Service. Any new features of the Service shall be subject to the most current T&C posted on the Website at all times. Your continued use of the Service, or purchase of goods and/or services after the making of such changes to the Service or to the T&C, will be deemed as consent and acceptance of such changes to the Service and/or to the T&C. You represent and warrant to Webjet SG that you will fully comply with the T&C. If you do not agree to the T&C posted on this Website, please do not use the Website. Therefore, you are strongly advised to review these T&C frequently while you continue to make use of this Service.
5. Rights and Restrictions on Use of the Service
5.1 You shall use Service for lawful purposes only and is provided solely for the purpose of assisting users in gathering travel information, determining the availability of travel-related goods and services, making legitimate reservations for you or for another person for whom you are legally authorized to act, or otherwise transacting business with travel suppliers; and for no other purpose.
5.2 You may not novate or assign any of your rights under this agreement to a third party.
5.3 You may not modify, adapt, sub-license, translate, sell, reverse engineer, recompileor disassemble any portion of the Website or software therein. You may only use this Service to make legitimate reservations or purchases and shall not use this Service for any other purposes, including without limitation, to make any speculative, false or fraudulent reservation or any reservation in anticipation of demand. This Service and the content provided in this Website, including the text, graphics, button icons, audio and video clips, digital downloads, data compilations and software, may not be copied, reproduced, republished, uploaded, posted, transmitted or distributed without the express written permission of Webjet SG, and/or its third party providers, distributors, or suppliers, except that you may download, display and print the materials presented on this Website for your personal, non-commercial use only.
5.4 You shall not use, authorize or permit any third party to use on your behalf any "robot," "spider" “clawer” or other automatic device, or a program, algorithm or methodology having similar processes or functionality, or any manual process, to monitor or copy any of the web pages, data or content found on this Website, in any case, without the express written consent of Webjet SG. You shall not utilize any software, application, or algorithm, whether integrated in a browser or otherwise, that modifies or adds content to the layout, design, or content of any Webjet SG webpage.
5.5 You agree that you will not transmit or otherwise transfer any web pages, data or content found on this Website to any other computer, server, website, or other medium for mass distribution or for use in any commercial enterprise, whether for the solicitation for funds, advertising or solicitation for goods and services or otherwise. You agree that you will not use any device, software or routine to interfere or attempt to interfere with the proper working of this Service. You agree that you will not take any action that imposes a burden or load on our infrastructure that Webjet SG deems in its sole discretion to be unreasonable or disproportionate to the benefits Webjet SG obtains from your use of the Service.
5.6 You are prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, indecent, inflammatory, pornographic or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law. In addition, you are prohibited from posting or transmitting any information which (a) infringes the rights of others or violates their privacy or publicity rights, (b) is protected by copyright, trademark or other proprietary right, unless with the express written consent of the owner of such right, (c) contains a virus, bug, disabling code or other harmful item, or (d) is used to unlawfully collude against another person in restraint of trade or competition.
5.7 You shall be solely liable for any damages resulting from any infringement of copyright, trademark, or other proprietary right, or any other harm resulting from your use of this Service. Notwithstanding the foregoing, if Webjet SG has notified you that you are prohibited from using the Service, then you have no license to use the Service and any access by you or on your behalf shall be unauthorized and unlawful. Webjet SG may provide notice under this or any other section of these T&C via an email sent to the email address contained in your user profile, or otherwise used to make a booking on this Website.
6. Intellectual Property
The trademarks, logos, and service marks displayed on the Website are the registered and unregistered trademarks of Webjet SG and/or third parties. The trademarks owned by Webjet SG and our third party providers, distributors, or suppliers, whether registered or unregistered, may not be used in connection with any product or service that is not ours, in any manner that is likely to cause confusion with users, or in any manner that disparages using or accessing the Service. Webjet SG does not grant any license or right to use any of the logos, pictures, or trademarks found on the Website. Unauthorized use of this Service and/or the materials contained on this Website may violate applicable copyright, trademark or other intellectual property laws or other laws. You must retain all copyright and trademark notices, including any other proprietary notices, contained in the materials, and you must not alter, obscure or obliterate any of such notices. The use of such materials on any other websitesor in any environment of networked computers is prohibited.
7. Making Reservations, Purchasing Tickets and Travel Restrictions
7.1 All airfares, prices and fees displayed by Webjet SG are in Singapore Dollars unless otherwise specified. Webjet SG assumes no responsibility, and shall not be liable for any losses, damages, costs, claims, expenses, or fees incurred due to currency fluctuations.
7.2 Webjet SG reserves the rights to cancel any and all bookings or other transactions you have made on the Website after you have been prohibited from using the Service, with no liability whatsoever to you.
7.3 We do not require registration for you to access or use the Service. However, you may be required to create a User Account in order to use the Service. If you request to purchase an airline ticket, hotel room, rental car or travel insurance, you may be asked to provide certain information needed to process your request, such as your name, billing address, credit card number, phone number and email address. You agree that the total amount of your request, including all fees, taxes (including goods and services tax (GST) and value added tax (VAT)), levies, shipping/handling costs and other charges and surcharges, will be charged to the credit card account number that you supply to us.
7.4 The total price for a reservation and purchase of a ticket includes a mark-up fee for our efforts in providing the Service, its services in fulfilling your request. The goods and services that you reserve and purchase through the Service are subject to the terms, conditions, rules and restrictions set forth by each of our third party providers, distributors and suppliers. Webjet SG shall not liable for any failure or delay on the part of any third party providing goods and services to you through this Website and shall not be responsible for any acts or omissions of airlines or other third parties in the course of delivery of such goods and services, except to the extent that cannot be excluded by Singapore law. By using this Service, you agree to be bound by such terms, conditions, rules and restrictions set by our third party providers, distributors and suppliers, including but not limited to compliance with all rules and restrictions regarding availability of fares, products, or services, restrictions against back to back ticketing (purchasing two or more tickets with overlapping travel dates in order to circumvent minimum stay requirements) and hidden city ticketing (purchasing tickets including segments which the purchaser does not intend to use in order to circumvent an air carrier's pricing structure and round trip for one-way ticketing). The use of certain ticketing practices may result in such actions including the cancellation of the ticket, denied boarding, revocation of frequent flier miles and other benefits, additional charges to your credit card, additional charges collected at the airport, or future invoicing.
7.5 You agree to the payment of all amounts when due (including additional taxes, fees and costs which may not be included in the quoted fare) and compliance with all rules regarding the availability of fares, products or services, including penalty fees arising from your failure to comply with such rules. Additionally, you agree to pay all duties, taxes, and related charges arising out of your use of this Website and the Service provided herein. You permit and authorise Webjet SG to charge the credit card provided by you for payment of all fees including the payment of penalties arising from your failure to comply with airline tariff rules. If payment is not received from the card issuer or its agents for any reason, you agree to pay us all amounts due on demand.
7.6 You are responsible for knowing the entry requirements for the country(ies) to which you are traveling or entering, including entry and visa requirements for transfer airports, prior to arrival at your final destination. Webjet SG is not obligated, in connection with its activity as an electronic conduit, to provide notice or information concerning any regulations with regard to passports, visas, customs or health. This being the case, the user shall be solely and exclusively responsible for obtaining, in a timely manner, said information for the country of destination and/or any transfer countries.
7.7 Buying a ticket through Webjet SG does not imply any guarantee of passenger's ability to enter the country of destination. You understand that Webjet SG is not responsible for determining passenger eligibility to enter any specific country and shall not be liable for any losses from resulting from the failure to meet passenger eligibility of that country.
8. Fees and Charges
8.1 Webjet SG charges a non-refundable booking fee at the time of ticket issuance.
8.2 You may send us an email if you want to change your previously issued ticket. Webjet SG charges a SG$50.00 processing fee per ticket on top of change fees that may be imposed by the third party provider, distributor, or supplier. However, some tickets may be non-refundable and not permitted for rebooking. Please note itmay take up to twenty-four(24) hours to respond to email requests.
8.3 For reservations using Webjet SG’s “69,000 Hotels” with various participating hotels (“Hotels”), you may book hotel accommodation or cancel the same free of charge for up to 48 hours prior to arrival, subject to the relevant Hotel’s reservation and cancellation policy.
8.4 In the event of no show and cancellation of your hotel accommodation bookingin high seasons,Webjet SG reserves the right to impose on you a cancellation feeor no show feeof SG$200.00 or impose such surcharges on you, equivalent to a minimum of one (1) night accommodation fee as stipulated by the relevant Hotel’s reservation and cancellation policy, including local government tax and services which may apply.
9. Online Transaction Service Fees
9.1 Webjet SG shall charge an online booking service fee, which is 6% of all airfares or min. SGD 20 for adults, SGD 15 for child and SGD 5 for infants, whichever higher will be charged, will be applied per passenger for all flight bookings but regardless of passenger types. Webjet SG reserves the right to vary such fees from time to time. You are advised to check the Website on current fees payable at the time of making your online booking. The total amount payable by you as displayed on the Website for your online reservation, shall include Webjet SG’s online booking service fee. Such fees will be charged to the credit card details you provided to Webjet SG.
10. Electronic-Ticket
An electronic ticket is a paperless method of ticketing flights that offers convenience as well as lower prices. Webjet SG will issue electronic or paper tickets as required by the various airlines. Webjet SG is not responsible for the type of ticket to be issued by the various airlines. Any request for paper tickets shall be at the sole discretion of the relevant airline to issue.
1.1 Other Charges
Fuel Surcharges / War Risk Insurance
11.1 Almost every airline adds surcharges such as fuel surcharges and/or war risk insurance (details please refer to War Risk Insurance Fact Feet of IATA at http://www.iata.org/pressroom/facts_figures/fact_sheets/Pages/war-risk-insurance.aspx) to the ticket prices for international destinations. Depending on the airline, the surcharge is included in the base fare that we display or is added as taxes and/or fees and therefore displayed separately. Using our lowest possible airfare search technology, for those airlines that include the fuel surcharge in their fare price, we display the price of the flight, inclusive of the fuel surcharge, as part of the base fare. For airlines that include the fuel surcharge as a tax, we add these surcharges to the amount of taxes collected.
Bag-checking fees
11.2 You are liable to pay for bag-checking fees, which may include, but are not limited to initial bag checking fees, additional bag checking fees and excess baggage weight fees by the relevant airlines which rules, regulations and amounts charged vary from airlines to airlines.
11.3 Such baggage fees cannot be pre-purchased at the Service nor factored into the base fare but are payable upon check-in with the respective airlines. Please be aware that many airlines do not accept individual bags or pieces of luggage that exceed certain weight restrictions. It is your responsibility to check with the respective airline prior to flight departure.
Quoted Prices on Website
11.4 Webjet SG offers a leading technology in fare-search methodology. However, airline prices and availability can change from one second to the next. As such, the actual prices charged by the airline may differ from Webjet SG’s quoted prices at the time of your request. Webjet SG shall not be held liable for your reliance on quoted prices on the Website.
Total Amount Chargeable
11.5 The fees and chargeslisted within this section are not exhaustive and the final price charged to you may include other charges, costs and fees.
No Representations / Warranties as to Fees and Charges
11.6 Webjet SG makes no representation or warranty of any kind regarding fees and charges payable by you. All information is provided to you “as-is”. Additionally, Webjet SG assumes no responsibility and makes no representation or warranty of any kind regarding your use of Webjet SG’s customer service agents, and shall not be liable for any damages, costs, claims, losses, or expenses that arise out of the same.
12. Amendments,Cancellations and Refunds
Flight Cancellation Policy
12.1 Webjet SG charges a flat cancellation fee of SG$50.00 per airline ticket for the cancellation or refund of any airline flight tickets, which will be in addition to such cancellation or refund charges as imposed by the relevant airlines pursuant to their terms and conditions regarding cancellation, penalty and refund. Airline charges or cancellation or refund fees may apply to your particular airfare.
12.2 Fees charged by Webjet SG for the initial reservation of the airline ticket made by you are not refundable.
Amendment Fees
12.3 No amendments of airline tickets purchased through this Service are allowed. Subject to the refund policy of the relevant airline, you may apply for a refund of your airline ticket and re-book an airline ticket through this Service. Should you re-book an airline ticket, please provide accurate personal details such as name as shown on your passport when booking your airline ticket through Webjet SG online platform.
Refunds
12.4 Refunds following cancellation of your airline ticket, are beyond the control of Webjet SG and are strictly governed by the terms and conditions of the airfare, as stipulated by the relevant airlines. You understand that some airfares may be non-refundable. Any refunds from our third party providers, distributors or suppliers will be made to you only after payment has been received by Webjet SG. Where a refund is applicable, the turn around time from the date of your request for refund to the date of refund may take up to 16weeks or even longer,which is wholly beyond the control of Webjet SG. You are advised to consult the relevant airlines regarding the turn around time for such refunds.
13. At Your Own Risk / Exclusion of Warranties
13.1 Whilst every effort has been taken to ensure the accuracy of the information contained on the Website, it has been provided from a number of sources and Webjet SG accepts no liability for the information provided on the Website. It is your responsibility to check the accuracy of relevant facts and opinions given on the site before entering into any commitment based upon them, and you agree use this Service entirely at your own risk.
13.2 All software provided in this Website are subject to the terms and conditions of the end-user licence agreements governing its use. You must comply with such end-user licence agreement. You agree that Webjet SG do not warrant any software under this Agreement.
13.3 Webjet SG does not provide any guarantees about the Service, whether expressed or implied. In particular, Webjet SG does not warrant that the products and services of the Website (a) will be able to meet your requirements, (b) will be availableat all times, nor (c) will be secure or free from errors or faults. Webjet SG does not accept any responsibilities for the accuracy, or contents of any digital information sent or received at the Websiteor any aspect of its operation.
13.4 You agree and accept that acquisition or receipt of data or other information depends entirely on your own discretion; and that you assume all risks associated with, and take full responsibility for such data and other information, including all loss or damage to you, Webjet SG and/or any third parties arising therefrom. Specifically, Webjet SG does not accept any responsibility for any financial transactions undertaken by you at the Website or redirected you to any third parties’ online payment gateway or for any loss or damage to you or any third parties howsoever arising from any such interaction.
14. Limitation of Liability
14.1 Webjet SG shall not be responsible to you or any third partiesfor any direct, indirect, incidental, special and sub sequential damage arising from the use of your user account beyond the limited purposes contemplated by these T&C, including the use by you of this Service for any commercial or financial transactions such as the online purchase of goods or services.
14.2 Webjet SG shall not be responsible to you or any third parties for any loss arising from any defects in technology, computer viruses, computer crash, actions of computer hackers (including denial of service attacks), difficulties in accessing the Website, shut down of computers, Service interruptions, loss of email content, delivery errors or delays, or receipt of corrupted or incomplete data.
14.3 All warranties and other terms, which are not expressly included in these terms and conditions, are excluded to the maximum extent permitted by law. Where we are liable to you under these terms and conditions and to the maximum extent permitted by law, our liability will be limited at our option to the maximum extent permitted by law. Webjet SG excludes all liability in relation to the Service.
14.4 We do not endorse or recommend any particular travel service provider, nor do we vouch for the accuracy or completeness of the information provided by third parties in relation to their products and services. Information provided through the Website is provided in good faith, and is subject to amendment at any time without notice. You should make your own evaluation of the accuracy or completeness of any information, opinion, advice or other content available through the Website.
14.5 You are solely responsible for the suitability of any travel services that you purchase through the Service. In particular, we are not liable for any inconvenience caused or expense incurred as a result of any unsuitability of travel services for use in association with other travel services, except to the extent that liability in relation to those matters may be imposed on us by legislation that cannot be excluded. Webjet SG's role in relation to your travel arrangements is limited to facilitating yourbooking and arranging travel documentation, payments and refunds as applicable.
14.6 Webjet SG accepts responsibility for the performance of this role and for the negligence of its employees. However, to the maximum extent permitted by law, Webjet SG disclaims all liability for any technical errors, corruption of data, unauthorised access to your personal data, inaccuracies in information supplied by third parties, or failure by Webjet SG to complete bookings where that failure is due to circumstances beyond its control.
14.7 Webjet SG accepts no responsibility or liability for any failure or delay on the part of any third party in providing travel services to you where your booking has been properly processed by it; nor is Webjet SG responsible for any acts or omissions of airlines or other third parties in the course of delivery of such travel services, except to the extent that responsibility for those matters may be imposed on Webjet SG by legislation that cannot be excluded. Where Webjet SG is liable to you under these terms and conditions its liability will be limited to providing the relevant booking services again or to refunding money paid in relation to services not provided because of Webjet SG's default. Where refunds are due to you from third party suppliers of travel products or services, Webjet SG will provide reasonable assistance to you in claiming such funds from those suppliers. To the maximum extent permitted by law, Webjet SG excludes all liability for direct, indirect, consequential or incidental damages, lost profits or savings or damages for disappointment.
15. Disclaimer for PlanitonearthTM
15.1 Services by PlanitonearthTM are provided at no charge and on an“as-is” basis, subject to the end-user licence agreement for such services; for which terms, you must comply with in order to use their services. Webjet SG does not make any representations or warranties about the availability, functionality or performance of PlanitonearthTM or the accuracy, completeness, currency or reliability of any of the content or data accessible via PlanitonearthTM. Webjet SG excludes all implied conditions and warranties in relation to PlanitonearthTM, including all implied conditions and warranties of merchantability, satisfactory quality, fitness for a general or particular purpose and non-infringement of proprietary rights, except for any condition or warranty implied by law, the exclusion of which would contravene any statute or cause any part of this clause to be void (non-excludable condition).
15.2 Webjet SG's liability for breach of any non excludable condition is limited, at Webjet SG's option, to refunding the price of the goods or services in respect of which the breach occurred or to providing, replacing or repairing those goods or providing those services again. To the maximum extent permitted by law, Webjet SG excludes all liability, whether in contract, tort (including negligence) or under statute arising from the operation or use of PlanitonearthTM.
16. Amendments
Webjet SG may at any time without prior notice to you or any other third parties has changed, suspended or terminated any or all aspects of the Websiteand shall not be responsible to you and/or any third partiesfor any loss arising therefrom.
17. Statement of Privacy & Security
17.1 Webjet SG is committed to protecting your privacy in the use of this Service. Webjet SG will not open, edit or disclose user information – such as username, residential address, email address and user account – and will maintainthe confidentiality of any other information stored in systems of this Website, except that we reserve the rightsto disclose your personal information:
17.1.1 to any of our group companies, affiliated companies, agents, distributors, suppliers, contractors or third party service providers who provide products and services to you through the Service or directly link with the Service for the purposes of selling, purchasing, redemption, marketing, promotion and provision of any products or servicesand also for online and offline payment transaction, managing bad debt and preventing fraud; facilitating interconnection and inter-operability between service providers, facilitating interconnection and inter-operability between service providers ;
17.1.2 if such disclosure is made pursuant to a legal proceeding, court order or as required by law;
17.1.3 if necessary, to protect the personal safety of users of this Website or the public; or
17.1.4 to protect and defend the rights or property of Webjet SG or other members of our group companies aforementioned in (1), including the ownership, operation and/or intellectual property rights associated with this Website (www.webjet.com.sg); or
17.1.5 where your consent is requested and given, for other lawful purposes, including without limitation, research; customer benefits and retention programme; to support your customer relationship with Webjet SG;
17.2 Other than your personal information as described above, you are not to provide Webjet SG under any circumstances, any confidential or proprietary information via the Internet. Any information (including feedback, data, comments, suggestions, ideas or the like) that Webjet SG (or its affiliates) receives from you through the Website, will be regarded as non-confidential. Webjet SG may from time to time conduct online surveys and request for information about your interest or your views about specific matters in an effort to improve its services to you. You may choose not to respond. By sending to Webjet SG non-personal information via this Website or through any other electronic means, you grant to Webjet SG and its affiliates an unrestricted, irrevocable license to use, reproduce, display, modify, perform and distribute such non-personal information in any manner and for any purpose as Webjet SG (or its affiliates) shall deem fit.
18. User Account and Password
18.1 You must safeguard your user account login identification name and password (collectively, “IDs”) as strictly confidential at all times. You must take all measures (including but not limited to changing your password from time to time) to protect the confidentiality of your IDs. You must not allow any third party access to or use of such IDs. The security of your account is your own responsibility. Webjet SG and/or any third parties are not responsible for any loss arising from the improper use of such ID(s). You can change your password at any time, or discontinue an old account and open a new account. However, we reserve the right to refuse or change or remove your ID(s). We will notify you of such refusal or removal.
18.2 If you discover or suspect that there has been any unauthorised use or disclosure of your ID(s) or that your account security has been compromised, you are required to report immediately to Webjet SG any suspected or known illegal use of user account, including your own and change your password.
18.3 You are required to log-on to the Service with your email and password. Your user account together with all information contained in it may be permanently deleted if you fail to properly log-on to the Service or do not make use of this Service within a period set out above. You are solely responsible for maintaining records of all your activities and transactions carried out under your IDs and/or account. We are not obliged to provide any historical data and/or to assist in providing such data to you.
18.4 Without prejudice to the foregoing, in the absence of fraud or manifest error, all records relating to your User Account are conclusive evidence of the accuracy, completeness and truth of all matters stated therein. Webjet SG’s decision on all matters relating to the activities and transactions carried out under your IDs and/or User Account will be final and conclusive.
19. Minors
If you are under the age of twenty-one (21), a minor or not capable of assuming legal responsibility, you should seek advice from your parents or guardians as to the meaning and consequences of these T&C before using and purchasing any of the products and services through the Service. You must not provide us with your personally identifiable information unless you have received the consent from your parents or guardians. Webjet SG presumes that every user of the Website has the requisite capacity required for any use and purchase of any of the products and services and, by using and purchasing any of the products and services, you undertake and warrant to us that you have the requisite capacity. Webjet SG is not obliged to verify the age or capacity or any users, but in the event it is discovered that any users lack the requisite capacity, Webjet SG reserves the rights as may be available against such users, or the parents or guardians of such users, including the right to be indemnified by them against all the loss or damage suffered by us as the result of the said lack of capacity or to cancel their registration and terminate their access to the Service.
20. Protection
You agree to maintain and protect the interests of Webjet SG and are responsible for all litigation and costs that may be incurred by us arising from your violation of these termsand conditions, including claims by or indemnities owed to any third parties howsoever arising.
21. Indemnification
You agree to defend and indemnify Webjet SG and/or their respective group companies, affiliatedcompanies, agents, distributors, suppliers, contractors,third party service providers, and any of their officers, directors, and employees from and against any claims, causes of action, demands, recoveries, judgments, losses, damages, fines, penalties or other costs or expenses of any kind or nature, including but not limited to reasonable legal and accounting fees, as a result of: (a) your breach of these T&C or other obligations or policies referenced herein; (b) your violation of any law; or (c) your use of this Service.
22. Termination
22.1 Webjet SG may in its absolute discretion, terminate, suspend or limit your use of all or parts of the Website or this Serviceor terminate access to your User Account at anytime without prior notice or liability to you.
22.2 Under no circumstances or at any time, will Webjet SG be liable for the limitation or suspension or termination of access to or use of your User Account, the Website or this Service. If you do not accept any changes to these T&C, you must terminate your continued use of this Service immediately.
22.3 Upon termination of these T&C, all rights granted to you will terminate and revert to Webjet SG and its third party providers, distributors, suppliers, agents, as applicable.
23. Communications
23.1 You consent to receiving communications from Webjet SG electronically and to communicate with Webjet SG by post, fax or email to the contact details as provided by you in our records.
23.2 You agree that all agreements, notices, disclosures and other communications which Webjet SG provides to you electronically satisfy any legal requirement that such communications be in writing.
23.3 You waive any rights or requirements under any legal requirement in any jurisdiction which require an original (non-electronic) signature or delivery or retention of non-electronic records.
24. Governing Laws and Jurisdiction
24.1 This Website is controlled and operated by Webjet SG from its offices in Singapore. We make no representation that materials in this Website are appropriate or available for use in other locations. Those who choose to access this Website from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent, local laws are applicable.
24.2 By using this Service, you agree that the T&C are governed by and construed in accordance with the laws of Singapore, without giving effect to any principles of conflicts of law. In the event of conflict, you agree that the laws of Singapore shall prevail, without reference to any conflicts of law principles. You further agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Services must be filed within one (1) year after such claim or cause of action arose or be forever barred.
24.3 By using this Service, you agree to submit to the exclusive jurisdiction of the courts of Singapore.
25. No Waiver
25.1 No failure or delay by Webjet SG to exercise or enforce any of its rights under these T&C will operate as a waiver of such rights nor will such failure or delay in way prejudice or affect its right at any time thereafter to act strictly in accordance with the rights of Webjet SG under the T&C.
26. Headings
The headings of the terms and conditions herein contained are inserted for convenience of reference only and are not intended to be part of or to affect the meaning or interpretation of any of the terms and conditions of this Agreement.
27. Entire Agreement, Severability and No Third Party Right
27.1 Webjet SG’s affiliates may enforce this Agreement against you. Save as aforesaid, a third party has no right to enforce these Terms & Conditions pursuant to the Contracts (Rights of Third Parties) Act and the consent of any third party (including Webjet SG’s affiliates) is not required for the variation, rescission or termination of this Agreement.
27.2 This Agreement contains the whole agreement between you and Webjet SG with respect to the subject matter here in and there are no agreements, understandings, promises, conditions or terms, oral or written, express or implied, including those you may issue, concerning the subject matter herein which are not merged into this Agreement and superseded thereby.
27.3 If any provision of this Agreement is held to be invalid, illegal or unenforceable (whether in whole or in part), such provision will be deemed modified to the extent, but only to the extent, of such invalidity, illegality or unenforceability and the remaining provisions of this Agreement will not be affected.
